The essay addresses the issue of the tour operator’s liability in the legal context of the United States of America. In particular, it considers the case in which the tourist is not afforded the conditions to fully benefit from the holiday period, due to the presence of an algae bloom that prevents bathing in the chosen seaside location. The contribution analyses a number of legal issues that contribute to the solution of the case, including the general legal framework of protection of the tourist-consumer, the doctrine of frustration of purpose, the compensation for damages in case of breach and its possible quantification.
