In the growing malpractice context, claims for missed diagnosis of foetal malformations present different and complex medico- legal problems. They need to be deeply analysed in these three main aspects: the identification of the possible clinician’s error, the type of information given to the woman about the foetal wellbeing and the damage evaluation. We present a peculiar case, in which the main problems are clarifying if the foetal malformation was recognizable during prenatal life (and when) and verifying the hypothesis that the missed identification of the foetal malformation was due to its actual absence at the moment of the foetal ultrasound examination contested.
