The purpose of this work is to investigate how the Swiss Federal Tribunal uses comparison in its daily activity; to what extent, how and for what purposes, henceforth, it refers to the foreign case law, legislation and doctrine, or comparative doctrine as well. Hence we’re not taking a comparative view on this issue, by the way much studied abroad, which will rather be the intent of the editors of this volume.
