The competence of domestic tribunals to render default judgments remains a matter for internal law and Article 23 is applicable insofar as such a competence exists. Article 23 successfully strikes a balance between the interest of the plaintiff to have the case adjudicated, even if the State concerned is reluctant to appear before the court, and the need to protect the rights and prerogatives of the State concerned.
