La presente indagine comparatistica pone a confronto l’istituto della prevedibilità del danno nell’illecito contrattuale così come sviluppatosi nel diritto inglese e in quello italiano. La scelta del tema di ricerca nasce dalla presa d’atto del recente dibattito riscontratosi in seno alla dottrina inglese in merito alla possibilità di riqualificare la contemplation rule quale strumento interpretativo volto a delineare l’implicita volontà delle parti circa l’allocazione dei rischi contrattuali. Nei primi due capitoli, dedicati rispettivamente al diritto italiano e al diritto inglese, si è svolta un’indagine storica dell’istituto e si è, poi, dato conto della pluralità di soluzioni interpretative accolte in dottrina e in giurisprudenza al fine di delineare le principali linee di tendenza e agevolare la ricostruzione dell’attuale funzione del criterio della prevedibilità del danno in ciascun ordinamento. Infine, nel terzo capitolo, dedicato alla comparazione, si è cercato preliminarmente di fornire una spiegazione della presenza di un tale dibattito sulla prevedibilità del danno nel diritto inglese, assente in Italia. Si è passati poi ad analizzare le differenze struttuali tra i due criteri, evidenziando l’assenza nel principio inglese di qualsiasi correlazione tra entità della colpa ed entità del quantum risarcibile. In generale, si ritiene che pur essendosi posti a confronto due sistemi giuridici in cui il contratto si è sviluppato secondo direttive diverse, si deve rilevare che il criterio della prevedibilità del danno venga utilizzato dalla giurisprudenza in modo simile.
This thesis deals with remoteness rule in contract both in the English and in the Italian legal systems. The idea of this topic came from the increasing support in the English contract literature of the view that the remoteness rule is concerned with identifying an implicit allocation of risk made by the contracting parties. Through analysis of the origins of the principle and its application in the recent case-law in England and Italy, the first two chapters, concerning respectively with English and Italian Law, show the new trends on remoteness rule and its role in each legal system. In the third chapter, dealing with comparative law, I first tried to understand the reasons of the development in the English contract literature of this new understanding of the remoteness rule absent in Italy and then I focused on the difference between the two rules, noting that in the English law there is no correlation between negligence and damages. In conclusion, the analysis shows that even if the two legal systems are very different especially with regard to the developmente of contract law, the remoteness rule is seen in both system as a method by which the courts allocates risks which the contracting parties have failed to allocate, rather than an interpreative rule.

Abstract
