I POTERI DATORIALI DELLA PUBBLICA AMMINISTRAZIONE IN ITALIA E IN SPAGNA LOS PODERES EMPRESARIALES DE LA PÚBLICA ADMINISTRACIÓN COMO EMPLEADORA EN ITALIA Y ESPAÑA

The thesis analyses the powers of the Public Administration as an employer, governed in Italy by the Testo Unico del Pubblico Impiego (d. lgs. n. 165/2001) and in Spain by the Estatuto Básico del Empleado Público (Real Decreto Legislativo n. 5/2015). First, the dissertation begins with the attempt to identify which is the interest of the Public Administration as a creditor in the labour contract, through the analysis of statutory and administrative rules. Therefore, the work investigates whether the private tools are appropriate to pursue the general interest and how the public interest plays in conforming the prerogatives of the public employer. Finally, it examines the incidence of the interest of the Public Administration as a creditor in the structure of the labour contract of public servants.

La tesi analizza i poteri datoriali privatistici della Pubblica Amministrazione in Italia e in Spagna, come enucleati, in particolare, dal Testo Unico del Pubblico Impiego (d. lgs. n. 165/2001) e dal Estatuto Básico del Empleado Público (Real Decreto Legislativo n. 5/2015, già Ley n. 7/2007). Si incomincia con l'individuazione dell'interesse creditorio dedotto nel contratto, attraverso l'analisi delle norme civilistiche ed amministrative in materia. Quindi, si è verificato se gli strumenti privatistici siano idonei a perseguire l'interesse pubblico generale e come si atteggi tale interesse nel conformare le prerogative datoriali della Pubblica Amministrazione. Infine, si esamina l'incidenza dell'interesse creditorio della Pubblica Amministrazione sulla struttura del contratto di lavoro privatistico del pubblico impiegato.
