The work start from the exam of historical forms of private paticipation to public works realization and to urban transformation works. Then it examines the roules evolution that had took place in the regions to find out of a bigger efficiency of the public interventions, and in the same time, of privat money. The exam of the unearded income as exential limit for a politics coerent development urbans riqualification of the local authorities. The whole is reported to a complex set of roules about the expropriation, and it had given to a study of new urban instruments that can involve the privats. In fact the evaluation is a very importat thing to make clearly every urban transformation work and it is also a critic element without reference rouls. In the same time it must to adopt to the speed evolution of instruments that have been experimented to give efficient a matter frustad by a long period of public inaction. The new role that the law reforms of the local autorithy had given to the administrators, had leaded to tangible politic of results. It had given the local authorities to find out a politic able to interfere with the real estate market. My thesis analyses also the same situation in France, that is very different because of the stronger politic intervention. The introduction of new tool - credito edilizio - as a regulator of the real estate market must consider the evaluation as a very important element to establish the conveniences of the different actors. In some time the market values of the urban products, that take possession of differential unearded income, became the essential assumption to the regulation of the transfer urban droits. The droits transfer had been made in the regional law of the follo wing regions: Lombardia, Veneto, Friuli Venezia Giulia, Trentino. Finally my thesis essaies to understand the way in whitch the droits transfers and the follo wing the market, could reflect the influence of the positional caratheristics over the building's market value. Also the public authorities as the first creator of the differential understand income, take a part to finance the public works realisation.
