I servizi pubblici locali ed il principio di sussidiarietà : il superamento della dicotomia tra pubblico e privato ed il nuovo ruolo dell'ente locale

This work focuses mainly on the evolution of local public services within the complex reform which has involved all spheres of Public Administration since the Nineties. The first part of the research is dedicated to reconstructing the extensive doctrinal and legal debate that has developed about the concepts of public service, considering the various reforms that have taken place over the years. The second chapter examines the various profiles of the current legislation framework, configured further to the latest new legislations, and in particular it deals with the landlord regime of the networks, plant and other instruments required for the public services; the networks and plant management; the service management. With regards the latter in particular, company management models have been analysed that are contemplated by current regulations for economically important service management (mixed companies and in-house providing). In the second part, the analysis aims at illustrating the limits and methods of intervention by local bodies in social-economic sectors, with special reference to regulatory functions and the instruments that can be used for their implementation.
