La sicurezza dell'insicurezza. Retoriche e torsioni della legislazione italiana

This article tries to give a synthetic report of the recent Italian legislation concerning the issue of security ad the related public order management ( so said “pacchetti sicurezza “). The contents of three last texts of law are classified roughly around five areas: penal sanctions, public policing, immigrant’s expulsion and control, contrast to immigrants inclusion, violation of fundamental human rights. Every section is essentially analyzed and criticized. Follows a critical review of the most evident characters affecting the concept of security today. Under this point of view three crucial relationships are considered: between the waiving of classic penal guarantees and the overcrowding of prisons; between this same phenomenon and violation of human rights in the security legislation; between political communication and the subversion of meaning between danger and repression. In the frame of this critical overview this article tries to focus some more particular aspects: the ambivalence of the political culture and language, the kind of public consensus, more rooted on absenteeism and lack of attention than on an active support to the repressive choices; the mix and contamination between social weakness and spirit of revenge as root of a new authoritarian culture.
