The idea of the paper is to tackling the issue of the interpretation of international law by relating it to the very nature of international law. The question from which this paper takes its cue concerns the choices made by the international community, in the guise of the International Law Commission, in codifying, in the Vienna Convention on the Law of Treaties of 1969, the so-called rules of interpretation. In public international law, the outcome of the codification of these rules cannot be considered to be a “failure” as in other legal orders. The “success” of the codification of the rules of interpretation relating to international law can provide us with answers to the question on the nature of the international order as such.
