Salute e riserbo del paziente: questioni aperte in tema di cartella clinica

Il contributo affronta, dopo una breve premessa circa la normativa di riferimento, le questioni applicative più attuali e spinose emerse in tema di cartella clinica. In particolare vengono approfondite le regole riguardanti l’onere della prova in caso di responsabilità medica per lesione della salute del paziente e i principi fondamentali relativi al rapporto fra privacy del malato e diritto di accesso alla cartella clinica. This article offers an analysis of the legal aspects of medical records and of the main principles operating on the ground, in the Italian system. It presents a review of case law on the subject, after a concise report about the relevant legislation. In particular, it focuses on the applications, made by the judges and the Data Protection Authority, of the rules by which the onus probandi is governed and of the ones connected to the relation between privacy and right to access, in reference to the medical records.
