The aim of the paper is to reflect on the role the Home State plays in foreign investment law in the light of some recent developments and in particular some innovative provisions contained in investment treaties or model treaties. The structure is simple as the paper is divided in three chronological parts: (a) the role traditionally played by the Home State; (b) the role played by the Home State in modern foreign investment law; and (c) the role the Home State may play in the future.
