Lo scritto sviluppa talune riflessioni, stimolate dalla capillare diffusione del Covid-19, in ordine alle problematiche connesse ad eventuali responsabilità penali a carico del datore di lavoro — e, in seconda battuta, dell’ente — derivanti dal non semplice intreccio tra normativa emergenziale e disciplina del d.lgs. n. 81/2008, affrontando il tema alla luce della natura del rischio derivante dal patogeno SARS-CoV-2.
