This paper traces the complex historical evolution of collective rights in Italy, examining the transition from forms of communal land ownership towards the paradigm of private property. The analysis focuses on the impact of the Civil Codes and the configuration of "civic uses" (usi civici) in the laws abolishing feudalism. It delves into the provisions of the 1927 law and the subsequent jurisprudential development, with particular attention to the assessment procedures. Finally, the paper discusses the codification in Law no. 168 of 2017 and the limitations of Constitutional Court judgment no. 119/2023, offering critical insights into the future of these rights.
