Il corpo della donna come prova. Lesbismo e problema della prova nel dibattito medico-legale e nei lavori preparatori del Codice Rocco

This paper examines the medico-legal and juridical debate regarding the evidence of lesbianism and its impact on the genesis of the Rocco Code. Starting from Article 528 of the preliminary draft dedicated to homosexual relations, it analyses the issue – raised by Commissioner Morello – concerning the impossibility of proving the commission of sexual acts between women. Through an examination of scientific literature (Casper, Tardieu, Martineau), the study highlights the methodological and scientific weaknesses of searching for anatomical alterations for evidentiary purposes. The result is the inapplicability of Article 528 to female cases.
